Amendments to the Customs Law (Official Gazette 82 of 2011)

The amendments to the Customs Law, effective since January, 1th 2012, delegate new powers to the customs authorities:

  • Investigation of crimes by the newly introduced institute of customs investigator (Article 10 of the CL). Customs investigators implement investigations in regards with the terms and conditions of the Criminal Procedure Code in respect of crimes against customs regime, currency and tax system.
  • In executing inspections under the post-clearance control or in the course of customs intelligence, customs authorities may conduct searches and seizures under the Criminal Procedure Code. Rights and obligations of the inspected persons are governed by the same code.
  • Detention of persons within 24 hours may be ordered by the customs authorities in respect of crimes against customs regime, currency and tax system, referred to Art. 234, 242, 242a, 251, 255 and 256 of the Criminal Code (Art. 16a and art.16b of CL).
  • Requirement to customs authorities before delivering a decision in connection with customs regulations in detriment of a person to notify him for the grounds for that decision and to provide him an opportunity to comment it within a specified period (Art. 19, par. 4 CL).
