We are one of the very few law firms in Bulgaria with considerable experience in advising foreign companies implementing construction projects under FIDIC conditions of contract. The most important problems faced by contractors in Bulgaria are related to the specific requirements of Bulgarian Spatial Development Act which often are in contradiction with FIDIC rules.

Our range of legal services includes, but not exclusively: consulting during the tender procedure, during the construction process - compatibility of the FIDIC’s rules with the Bulgarian imperative legislation, differentiation of the respective obligations of the Employer, Contractor and Engineer, claims procedures for extension of time and additional costs under the FIDIC, legal advices during the procedure before the Dispute Adjudication Board and consultation on the issuance of the Taking-Over Certificate.   

Our experience in the field of constructions covers:

• We are rendering ongoing legal advice to a foreign company on its operation as a contractor under yellow FIDIC book in a EUR 100 million project.
• We advise and issue legal opinion for a foreign company implementing rehabilitation of thermal power plant (EUR 226 million).
• We advise a foreign company on the requirements of Law of Spatial Planning in a EUR 24 million project under red FIDIC book.
• We provide legal services to a construction project in Russia (EUR 153million).

In the field of the renewable energy sources “Dyulgerova and Penkova” Law Firm has advised foreign clients in respect of planned investments, including selection of the type of investment (acquisition of real estates or acquisition of company shares), preparation of legal and financial due diligence regarding procurements, drafting of commercial agreements, escrow account agreements, consultations related to acquisition of real estates, designing and construction of photosolar parks, etc. Until the present moment the law firm has successfully finished two projects in this area.
